By-Law: Installation and Use of Electric Vehicle Charging Infrastructure

1. Purpose

This by-law governs the installation, maintenance, and use of electric vehicle (EV) charging infrastructure, aligning with the Strata Schemes Management Act 2015, the National Construction Code, and relevant Australian Standards. It ensures safety, equity, and sustainability across SP3840 – The Pines.

2. Legislative Basis

Pursuant to amendments made under the Strata Schemes Management Amendment Bill (2023/2024) to Section 132B, EV charging systems are deemed “sustainability infrastructure.” As such, the Owners Corporation must not unreasonably withhold consent for their installation and must assess applications accordingly.

3. Definitions

  • EV Charger: A device/system for charging electric vehicles.
  • Infrastructure Assessment: A certified electrician’s evaluation of the building’s electrical capacity and safety.
  • Common Property: As defined under the Strata Schemes Development Act 2015.
  • Lot Owner: An individual who owns a lot within SP3840.

4. Approval Requirement

Prior written consent from the Owners Corporation is mandatory before installing any EV charger. Approval will not be unreasonably withheld, provided the proposal complies with this by-law and all associated guidelines.

5. Application Requirements

Applications must include:

a. Product specifications

b. A site plan showing installation location

c. An Infrastructure Assessment by a licensed electrician

d. Certification of compliance with AS/NZS 3000 and AS/NZS 3008

e. Assurance that no power will be drawn from common property without prior written agreement

6. Installation Conditions

a. Installation must be conducted by a licensed and insured professional

b. Work must preserve building safety, access, and ventilation

c. All associated costs are the sole responsibility of the lot owner

d. Chargers should be metered to the owner’s lot where feasible

7. Ownership and Maintenance

The lot owner remains fully responsible for the charger, including upkeep and any necessary repairs or replacement.

8. Liability and Indemnity

8.1 The lot owner or occupant must indemnify the Owners Corporation against liabilities arising from breaches of this by-law or the installation/use of the charger.

8.2 This indemnity excludes damages due to negligence by the Owners Corporation or its agents.

9. Prohibited Charging

EVs must not be charged using common property power without written approval. Unauthorised use may result in disconnection and cost recovery.

10. Removal or Transfer Upon Sale or Disuse

Upon sale or disuse, the lot owner must either:

a. Transfer ownership and maintenance to the new owner, or

b. Remove the charger and restore the area, unless otherwise agreed.

11. Review of By-Law

This by-law may be reviewed and amended to reflect legal, technological, or infrastructure developments.
